Bulgaria President to approach Constitutional Court over amendments to Black Sea Coast Act

  President of the Republic of Bulgaria Rosen Plevneliev published the bill on amendments and supplements to the Black Sea Coast Development Act in the State Gazette but will approach the Constitutional Court over some of its texts, the press centre of the President’s Office announced.
The Bulgarian Head of State welcomed the amendments with which the legislative power showed that it realised the need to preserve the few natural and untouched beaches in Bulgaria. The President also backs the step towards declaring the Irakli, Byala-Karadere and Koral as beaches for environment-friendly tourism.
However, the President of the Republic of Bulgaria expects the institutions in charge of the implementation of the state policy in the field of tourism and preservation of the Black Sea coast to take following actions that will guarantee to the maximum the preservation of the overall image of these beaches. 
According to him, the ban on giving the beaches on concession, as well as on the realisation of economic activity there, are indeed measures aiming to protect them but they are not enough. 
It is impossible to preserve the biological diversity and the eco-systems of these beaches, as well as their natural state, if construction works are allowed there. There is a need to also respect the needs of some of the Bulgarian citizens to rest as close to the nature as possible instead of staying at hotels. In this respect, the responsibility and the role of the state is to establish rules that guarantee the right of every Bulgarian citizen to use the natural richness and resources of the country and to find the balance between the different needs.
The President is not authorised to require concrete rules, neither by imposing a veto nor through legislative initiatives, but yet he calls upon the members of the parliament and the Council of Ministers to do it. 
The Bulgarian Head of State thinks that there is a need of an overall policy on the development of tourism and the preservation of the Black Sea coast, including rules concerning the camping. 
According to Mr Plevneliev, it is not the camping that changes the image of the Black Sea coast on the long run but rather the construction of buildings.
The lack of clear vision about the preservation of the few natural territories saved from constructions is concerning but it is not a subject of these legislative amendments. 
There is a need of rules regulating both the construction works and the camping, the president says. 
The Bulgarian Head of State thinks that the problems cannot be solved with the introduction of fine of BGN 1,000 to BGN 10,000 for parking and camping in the beach areas. 
The introduction of high sanctions for formal violations without taking into account the level of impact on the natural resources and the environment is in violation to Article 55 f the Constitution of Bulgaria and Article 52 of the EU Charter of Fundamental Rights and they are non-proportional. 
That is why President Rosen Plevneliev will address the Constitutional Court with a request to ascertain the anti-constitutional character of the introduced sanctions for camping and parking.
