Parliament adopts the SJC report without the support of the Blue Coalition and Ataka party


Yesterday, after a nearly two-hour debate, lawmakers adopted the report of the Supreme Judicial Council (SJC) and the SJC Inspectorate on its operations in 2010. The report was approved by the vote of the GERB (Citizens for European Development of Bulgaria) government and the Opposition. A total of 109 MPs of GERB, the Bulgarian Socialist Party, the Movement for Rights and Freedoms voted in favour of the reports along with independent parliamentarians. In fact, four MPs of the Blue Coalition and Ataka party were against and five ones abstained. Actually, the positive vote of the lawmakers supported SJC at a moment when several organisations demand the resignations of senior magistrates.

"SJC not only allowed, but also became responsive to political interference," declared the Blue Coalition's Co-Chair, Ivan Kostov. In his words "the erosion in the Council started after the scandal over the notorious businessman Krassyo the swarthy man remained unclarified.

The peak of the moral crisis in the SJC, however, happened when financial incentives were allocated to the SJC panel at the end of last year. "The whole country is economising, while only the SJC gives away premiums to its members. This is the actual impression left. Due to these unduly premiums Bulgaria will not join the Schengen area," retorted Kostov. His DSB (Democrats for Strong Bulgaria) Deputy, Ekaterina Michaylova was not less explicit. She demanded that a constitutional debate be held on the reduction of the number the SJC panel. Currently, the Council contains 25 magistares, whereas 11 member were elected by Parliament, 11 people by the Magistrates' Community, while the three SJC Chairs were designated by right.

"Indeed, we are  facing a severe hardship. It is impossible that the public confidence in the political system is low, while at the same time trust in the judiciary is high" stated Yanaki Stoilov from the Coalition for Bulgaria. He insisted on effective dialogue between the institutions. The latter was objected to by the MRF. "During the past two years, we have been observing exactly this phenomenon - one regular and thorough communication between the judicial and executive power, which, however, rather than leading to better performance of the judiciary, had yielded the opposite results. This is a pseudo communication," indicated Chetin Kazak. SJC itself was presented by its Chair, Anelia Mingova. She acknowledged that there were problems "with the governing cadres, but their resignation will deepen the instability of the institution."
