Almost 76% of public procurement orders in Bulgaria vitiated

Almost 76% of the public procurement orders in Bulgaria have been vitiated, showed data from a survey carried out by the Institute for Legal Analysis and Research, to be presented to the European Commission at the end of September. Peter Bakardzhiev, Chairperson of the Institute’s Governing Board, said for klassa.bg that the survey included 87 municipalities and the results showed that in over 50% of these the rules for conducting public procurement tenders were non-transparent. Some municipalities, such as Nessebar, refused to participate in the project. Others, such as Sozopol, have poor internal rules for assigning the public procurement orders. However, there are also municipalities such as Dolna Mitropoliya, Kavarna, Belitsa and others, which can serve as an example of transparent internal rules.

The Institute warned that at the end of the programming period, expiring in 2013, the inspections of municipalities implementing European projects will be more frequent and the stipulated financial sanctions are of a large amount, previously unknown in Bulgarian legislation. “Bulgaria will not be tolerated as a major violator of public procurement orders,” warned Bakardzhiev. He specified that a Directive is being discussed at present, aimed at changing the legislation in the Community regarding public procurement.

According to the Institute, the increase in the instances of violations in our country is due to the fact that there are gaps in the relevant Bulgarian legislation. The lawyers involved in the project believe that there should be a clear line between administrative offences and crimes so as the prosecution and the court would not have doubts about how to proceed.
