CPC imposes fines of BGN 4.85 mln in 2010


Last year, the Commission for Protection of Competition imposed fines and property penalties amounting to a total of BGN 4.856 mln, read the report on its activities which was submitted for discussion to the parliamentary Budget and Finance Committee yesterday. In 2010, the Antimonopoly Committee of Bulgaria initiated a total of 1,146 legal proceedings, 936 of which were pursuant to the Public Procurement Act, while 6 of these were launched in accordance with the Concessions Act and 204 lawsuits were instigated under the Law on Protection of Competition, read the document. According to it, last year the Committee ruled on 1,061 decisions and resolutions which completed the relevant proceedings.

A total of 834 of these decisions and resolutions related to the application of the Public Procurement Act. 537 of these were instituted on requests for the suspension of procedures for a contested contract or a granted concession. CPC also initiated 93 lawsuits for the establishment of unfair competition. The most frequent violations in the field of unfair competition continued to be associated with the fraudulent imitation of goods and services of competitors and unfair advertising aimed at attracting clients. A positive growth was also observed in the instigated legal proceedings for breaches in the field of prohibited advertising, reported CPC.
