The Monitoring Report of the European Commission critises Boris Velchev and Lazar Gruev


Yesterday, the Monitoring Report of the European Commission (EC) criticesed personally the Chief Prosecutor, Boris Velchev and the Chair of the Supreme Court of Cassation (SCC) of the Republic of Bulgaria, Lazar Gruev. This sfor the first tisme since December 13, 2006, when the EC put under surveillance the judicial system. Brussels blamed two magistrates of being passive and of a lack of a commitment as to implementing judicial reforms.


"The Prosecutor-General and the SCC Chair failed to analyse the shortcomings in the application of the law and failed to act accordingly afterwards," read the report. According to experts from Brussels, the passive attitude of both judges, as well as that of the Supreme Judicial Council concerns "deficiencies in judicial practice which raises serious concern."

The entire report was announced in public by Prime Minister, Boyko Borissov  to GERB (Citizens for European Development of Bulgaria) MPs at the National Assembly in the early afternoon. While delivering the report, the PM commented along basic EC conclusions. "I hope the magistrates will read the report as they should - with every single line considered and Brussels' recommendations taken into effect," said the PM, adding that he had already spoken to the Prosecutor General and the Interior Minister. The report itself contains a direct recommendation to Boris Velchev to analyse the reasons for acquitting persoins involved in high-profile corruption cases.

"The decision whether or not to appeal is under the jurisdiction of each prosecutor supervising the case rather than that of the Prosecutor's Office," retorted Boris Velchev.
