Higher fines for illegal constructions demanded

"The administrative penalty provisions on illegal construction need to be augmented," said the Chief Architect of Sofia, Peter Dikov in an interview for Focus news agency.
He stated that the fines should be increased because an order could be imposed by sanctions alone. The Chief Architect commented that this was one of the things that needed to be involved in the drafted amendments to the Spatial Planning Act (SPA).

“First of all, the lower limit of the penalties should be increased. Moreover, an emphasis should be placed on tackling the so-called temporary movable sites. A clear definition needs to be established for such sites, describing precisely what they are. The reason is that there are different practices in the municipalities and there are different judgments on legal arguments on these issues and therefore the various types of sites should be precisely specified,” said Dikov.
Stalls are the biggest problem in Bulgarian resorts, especially those along the Black Sea coast. According to the Chief Architect, the Law on the Spatial Planning of the Bulgarian Black Sea Coastline addresses this problem, but to a greater extent it concerns the SPA, so these issues should be regulated there as well.
The amendments to the law will increase the rights and responsibilities of the local authorities, especially regarding the control of construction. Municipalities, in practice, have the information and the ability to control the construction. According to the Law, illegal construction is the construction carried out in violation of the building plans or without building plans, but these are being kept by the local authorities. "There are opinions that the control can not be entirely transferred to the local authorities, because some people can not assume that the municipalities are able to perform such functions," said Dikov.
