Tacit consent becomes a universal principle

Tacit consent becomes a universal principle in the relations between businesses and the public administration. It will apply in all cases in which officials do not respond to requests of companies within a specified period. This is envisaged in the amendments to the Act on Limiting Administrative Regulation and Administrative Control on Economic Activity approved by the Government yesterday. This law was adopted in 2003 by a majority of the National Movement for Stability and Prosperity but it actually never became efficient.

Currently, the tacit consent principle applies only to permits and certificates for single transactions, and under the condition that it is not in conflict with other provisions. "The idea is for the tacit consent to be granted a priority over other special legislative provisions," said Minister of Economy, Energy and Tourism Traicho Traikov after the meeting of the Cabinet.

"Under the changes proposed, state and municipal taxes paid by businesses will be formed on expenditure basis alone. This means that they will only cover the cost of the service and not the bonuses for the respective administration," said Traikov.

According to the Minister, the new requirement for the establishment of fees is not a way to collect money for additional financial incentives of the administration. "We do not want for this approach to become a business activity, helping the administration to receive more money," said the Minister. "We will seek other options to improve remunerations in the administration by implementing the administrative reform on which we are working together with Deputy Prime Minister Simeon Djankov," added Traikov. According to the amendments to the law, additional money will not be requested from the companies for elimination of irregularities in the requests or for detailed information. Furthermore, applicants will be able to electronically monitor the movement of their documents.
