Up to 10 days of paid leave can be transferred to the following year


Up to ten days of the paid annual leave can be left for the following calendar year, MPs decided yesterday approving the amendments to the Labour Code on second reading. The initial proposal stipulated the possibility for transferring of up to 20 days of the annual paid leave to the following calendar year - 10 days on the demand of the employer for production reasons and 10 days at the discretion of the employee for important personal reasons. Ultimately, however, the MPs decided that up to 10 days – both for personal and production reasons - might be left and used the following year. According to Hassan Ademov, MP from MRF (Movement for Rights and Freedoms) and Deputy Chairman of the Parliamentary Social Committee, under the new amendments, if the employer has transferred 10 days of the annual paid leave for production reasons, "any subsequent important personal reasons become unimportant reasons".

The remaining paid annual leave for 2010, including the postponed leave, may be used until December 31, 2012, decided the MPs. The majority did not support the proposals of the left-wing, MRF and the Blue Coalition MPs provisioning that the leave for 2010 or part of it could be used for an indefinite period of time in the future, like the leaves for 2008 and 2009. The opposition warned that the recent amendments to the Social Code might also be revoked by the Constitutional Court because they deprive of rights retroactively.
