Margarita Popova: The report of the European Commission will be positive

The report of the European Commission (EC) on the progress of Bulgaria in the field of justice and domestic and legal policy will be positive, announced yesterday Justice Minister Margarita Popova after the roundtable discussion dubbed "Justice Closer to the People". She specified that the difference between the upcoming report, which is expected in late July, and the interim one was that it will deliver a more in-depth analysis on all sectors of the judicial system. "I expect that the EC will issue its consecutive remark that the courts and prosecutor's offices at the local level must consider seriously the provision of law enforcement services of higher quality in order to create a feeling that all citizens are equally treated in terms of individual cases," specified Popova.

"The magistrates demonstrate no will for moral catharsis," according to one of the conclusions stated by the authors of the survey named ''Justice Closer to the People''. It was conducted in the period February 2010 - April 2011 and covered overall 20 courts in Northern Bulgaria. According to the conclusions, judges almost never report complete and accurate data for the persons related to them. Most often, in the statements they indicate only their initials rather than the full data of their interrelationships.

In order for this problem to be solved, they recommend that judges should declare their involvement in organizations, clubs, hunting parties and charitable organizations. "It often happens that magistrates, businessmen and politicians are members of the same hunting party, or the same club," explained Georgi Milkov, one of the authors of the project.

Another proposal refers to the introduction of a restriction in the Judiciary Act, which should prohibit judges from being involved in election commissions. In his words, the participation of magistrates in these bodies places them in a conflict-of-interest situation, especially when the acts are appealed before the court.
