ЕА General Labour Inspectorate proposes legal amendments due to the evasion of social security contributions



The Executive Agency (EA) General Labour Inspectorate (GIT) is proposing a legislative amendment which will curb the evasion of social security contributions on the part of employers through the signing of a contract for a 4-hour working day, explained yesterday the Executive Director of the Agency, Rumyana Mihailova. If it is proven that the employee has been working more hours than the ones stated in the part-time labour contract, the latter will be recognised as a full-time employment agreement. Mihailova announced that the proposal will be immediately submitted to the Minister of Labour and Social Policy, Totyu Mladenov.

So far, since July, 3 a total of 281 cases of employees working without a labour contract at the Black Seaside were detected by the GIT. Rumyana Mihailova explained that, until that moment, 6,149 people hired at 798 establishments have been checked, while the inspections continue. The number of employees working part-time was 529. Besides, 96 offenders were penalised with sanctions and 18 cases referred to the illegal employment of minors without authorisation or in violation of the labour arrangements set for them. The majority of the infringements were related to non-compliance with the legal labour regime, as well as with respect to the non-observance of daily and weekly work-rest periods of the employees.

From the beginning of the year until the end of June, a total of 10,516 statements of administrative infringement were drawn up. All rulings setting a penalty higher than BGN 1,500 may be appealed. So far, a total of 10,300 claims for a breach of employment rights have been lodged with the Labour Inspectorate, or 20% more than the number of complaints filed for the same period last year. "In fact, there were no cases of serious obstruction of the inspections of the GIT inspectors carried out along the Black Sea resorts," declared GIT's Director, specifying that there was a positive trend concerning employers, who must fix the irregularities very quickly.

Yesterday, it became clear that a total of 110 assistants will be appointed to the Labour Inspectorate within the framework of the project "Improving the Monitoring of Labour" under OP Human Resources. The project worth about BGN 2.5 mln will continue for 30 months. The only requirement for the applicants is that they should be university graduates regardless of the field of study. The first officials will be appointed on August 15. They will receive a basic monthly salary of BGN 350, while their duties will be to assist the labour inspectors when inspecting the establishments. Besides, they will be responsible for the drawing up of the statement of administrative infringements.
