The Constitutional Court confirms the right of banks and NRA to collect their receivables under a simplified regime

The Constitutional Court ruled against the Ombudsman's litigation that challenged banks' and the National Revenue Agency's privilege to collect their receivables from debtors under a simplified regime. The Civil Procedure Code provides for the right of NRA and financial institutions to demand a court-issued writ of execution and distraint of the property of debtors in default on the basis of relevant documents or balance books excerpts. In cases where debtors challenge, the matter is resolved in court. The panel of Constitutional Court judges reached a unanimous decision, ruling that the state, municipalities and banks need these privileges given the fact that their receivables are of strong public interest.

Among written statements pertaining to the case, only the Supreme Bar Council was against the state and municipalities keeping their privilege. At the same time, the National Association of the Bulgarian Business, the Bulgarian Industrial Association, the Bulgarian Chamber of Commerce and Industry, the Centre for Legal Assistance and European Politics and the Bulgarian National Association Proactive Consumers all backed the Ombudsman's claim regarding banks. The Government Council NRA, the Bulgarian National Bank, the Financial Supervision Committee, the Association of Banks in Bulgaria, the Institute of Modern Politics and the Commission for Protection of Competition all said that the Ombudsman's demand is unfounded.
