Prosecution requests a fine for Stanishev for lost documents, containing classified information

The prosecution submitted a proposal to the Sofia City Court for exempting the leader of the Bulgarian Socialist Party (BSP) and former Prime Minister Sergei Stanishev from criminal liability under charges for lost documents, containing classified information, announced yesterday officials from the State prosecution. The reason for this proposal was that the acts did not cause material damages, and Stanishev had no criminal record.

The socialist leader was charged for loosing seven documents with information representing a State secret, in the period November 4, 2005 - September 10, 2009, while the criminal acts had been performed in a long lasting time period, explained the prosecution. The Criminal Code provides for up to 2 years imprisonment or probation in such cases, which means that if the accused person has no criminal record, the prosecution may submit a proposal for his exemption from criminal liability and for the imposition of a fine in the range between BGN 1000 and BGN 5000. For that reason, the prosecution proposed that Stanishev be punished with fine alone. However, the court will decide whether such a sanction would be imposed, when the case is actually tried, lawyers commented.

The pre-trial proceedings against Stanishev began in November 2009. A month earlier Prime Minister Boyko Borissov said that the classified report of the State Agency for National Security, which was submitted to former Prime Minister, Sergei Stanishev, and contained names of individuals and groups that had impeded the operation of ministries and other State institutions was illegally taken out of the Council of Ministers by the BSP leader. He announced this fact a day after the lately investigated Alexei Petrov, had delivered him the original copy of the document.
