Todor Kolarov demands a new law on property acquired from criminal activity

A proposal for renaming the Criminal Assets Forfeiture Law to Law for Counteracting Unexplainable Wealth was made today by Todor Kolarov, Chairman of the Commission for Establishing Property Acquired from Criminal Activity, on the Bulgarian National Radio (BNR). According to him, the current name of the law narrows its scope of application and is inefficient when investigating “the high levels of heavy organised crime and political corruption”. Kolarov explained that he had already presented his vision for the new legislative provisions to Justice Minister Diana Kovacheva.

“Let’s see the bill drafted by the Minister of Justice. Significant amendments might be made or a new bill drafted,” added Kolarov. He vindicated the idea of non-conviction-based asset forfeiture.

Meanwhile, the Movement for Rights and Freedoms came up with its own version of the law on civil forfeiture, stipulating the suspension of the commission chaired by Kolarov. “The National Revenue Agency will take over its functions,” Çetin Kazak from MRF told Klassa. According to the proposal of MPs from MRF, the NRA should launch investigations upon requests by prosecutors. The investigations will be against defendants accused in specific crimes such as kidnappings, ordered homicides, heading criminal gangs, drug and human trafficking, etc. Disparity between income and spending amounting to BGN 300 000 may also be a reason for instituting investigation proceedings. They should last about six months.
